TERMS & AGREEMENTS

Use EvoMind
with clarity.

These Terms & Agreements explain the rules for using EvoMind AI, its web workspace, its Windows application, connected tools, model services, and account features.

Effective: August 16, 2026Version: 1.0
Please read before using EvoMind.

By creating an account, signing in, purchasing access, or using the service, you agree to these Terms & Agreements. If you do not agree, do not use EvoMind.

1. Agreement and scope

These terms govern your access to EvoMind AI, including the website at evomind.ca, the EvoMind Windows application, account services, model responses, Visual Intelligence, connected application adapters, memory, and related documentation. “EvoMind,” “we,” and “the service” refer to the EvoMind AI product and its operator.

You must have the legal capacity to enter an agreement. If you use EvoMind for an organization, you confirm that you are authorized to accept these terms for that organization.

2. Accounts and access

You are responsible for the accuracy of your account information, the security of your password or authorized sign-in provider, and activity performed through your account. Do not share account credentials or use another person’s account without permission.

Free access, paid access, message limits, model availability, and connected-application features may differ by plan and are controlled by the account service. Paid access begins only when the account service confirms the applicable transaction or entitlement. Access expires when the server-verified entitlement expires.

3. The model is an assistive system

EvoMind can make mistakes. Its responses, classifications, code suggestions, decompilation explanations, labels, plans, images, and other outputs are assistance, not a guarantee of correctness. You must review important outputs and independently verify actions before relying on them.

EvoMind is not legal, medical, financial, safety, employment, or professional advice. Do not use it as the sole basis for a high-impact decision or a safety-critical operation.

4. Connected applications and actions

You may connect applications such as Ghidra, Visual Studio, or other supported tools. You must have permission to access the computer, project, binary, source code, account, and data that you connect.

You remain responsible for reviewing requested actions and their consequences. EvoMind may read context supplied by a connected application and may propose or perform an action when you authorize the relevant capability. You must not use a connected adapter to bypass authentication, licensing, access controls, software protections, or another person’s rights.

5. Acceptable use

You may use EvoMind only for lawful, authorized, and responsible work. You must not:

  • use the service to violate law, contracts, privacy, intellectual-property rights, or third-party terms;
  • request or facilitate credential theft, unauthorized access, malware deployment, evasion, destructive activity, or harm;
  • submit personal information, secrets, private keys, passwords, or regulated data unless you are authorized and the submission is necessary;
  • probe, overload, scrape, bypass rate limits, defeat plan controls, or interfere with service security;
  • extract model weights, system prompts, confidential evaluation material, private account data, or security controls;
  • use EvoMind to build or train a competing system from protected service material, except where applicable law expressly permits it; or
  • misrepresent EvoMind output as independently verified work when it has not been reviewed.

6. EvoMind intellectual property

EvoMind and its licensors retain all rights in the EvoMind name, brand, software, model weights, model architecture, prompts, system instructions, evaluation methods, interfaces, adapters, documentation, and service design. These terms grant you a limited, revocable, non-exclusive right to use the service for your authorized work. They do not transfer ownership of the model or its underlying technology.

You may not copy, sell, sublicense, publish, redistribute, decompile, disassemble, reverse engineer, or create a derivative service from protected EvoMind materials, except to the extent a restriction cannot legally be enforced. You may not remove attribution, conceal the source of protected materials, or use technical measures to defeat a control.

7. Your content and model improvement

You retain your rights in content that you submit. You grant EvoMind the limited permission needed to host, process, transmit, secure, display, and return that content to provide the service.

Account conversations and account memory remain scoped to the account. Raw private conversations are not automatically published as shared model training. Shared improvement may use only material that is deliberately confirmed for teaching, filtered for sensitive information, reviewed through the EvoMind learning process, and approved for a model release. A generalized approved model release may not be reversible, even though the source conversation and account records remain subject to the account controls described below.

You must not submit content that you do not have the right to process. Remove secrets and unnecessary personal information before uploading text, images, source code, binaries, or workspace context.

8. Visual Intelligence and generated content

Image analysis and generation depend on configured service providers, safety limits, and availability. You are responsible for the rights, privacy, and legality of images and prompts you submit. Generated content may resemble existing works, may be inaccurate, and may not be suitable for every purpose.

Do not use Visual Intelligence to identify a person, infer sensitive traits, or process private material unless you have a lawful basis and the required permission.

9. Plans, payments, and cancellations

Plan prices, duration, limits, and availability are shown at the time of purchase. Payment processing may be handled by a third-party payment provider. EvoMind does not receive or store your payment password or third-party authentication credentials.

Receipts and payment references may be reviewed before access is activated. You may cancel an eligible recurring plan through the account billing controls. Cancellation, refunds, taxes, and mandatory consumer rights are governed by the applicable payment terms and law.

10. Privacy notice

EvoMind collects and uses account information, authentication details, conversation and workspace data, connected-tool context, billing references, security events, and usage information only as needed to provide, secure, support, measure, and improve the service. Account export and deletion controls are available for account-scoped records.

Service providers may process information on EvoMind’s behalf. We use access controls, server-side entitlement checks, rate limits, and audit protections, but no online service can promise absolute security. We retain information for as long as necessary for the stated purpose, legal obligations, security, dispute handling, and approved model-release integrity.

For privacy requests or questions, use the support channel made available through evomind.ca. We will handle requests according to applicable privacy law and the service’s account controls.

11. Availability and third-party services

The service may be changed, limited, suspended, or unavailable for maintenance, security, provider outages, capacity, or reasons outside EvoMind’s control. Connected applications and payment providers are third-party services with their own terms, availability, and privacy practices.

12. Disclaimers

To the maximum extent permitted by law, EvoMind is provided on an “as available” and “as is” basis. We do not promise that the service will be uninterrupted, error-free, secure against every threat, compatible with every environment, or correct for your specific task. Nothing in these terms removes a consumer protection or other right that cannot legally be excluded.

13. Liability and indemnity

To the maximum extent permitted by law, EvoMind and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages, or for loss caused by your failure to review output, secure your account, maintain backups, or authorize only appropriate connected actions. Where liability cannot be excluded, it is limited to the amount you paid for the affected service during the applicable period, subject to mandatory law.

You agree to defend and hold EvoMind harmless from claims arising from your unlawful use of the service, your violation of these terms, your infringement of another person’s rights, or your unauthorized submission or processing of content.

14. Suspension and termination

We may restrict or end access when reasonably necessary to protect users, the model, the service, third-party systems, or legal rights, including when an account violates these terms or attempts to defeat access or security controls. You may stop using the service at any time. Account deletion does not restore or remove rights that have already arisen under applicable law or a completed transaction.

15. Changes and applicable law

We may update these terms as the service changes. The version and effective date appear at the top of this page. Material changes will be presented through an appropriate account or service notice. Continued use after the effective date means you accept the updated terms.

These terms are interpreted under the law that applies to the EvoMind operator and your transaction, without limiting mandatory consumer, privacy, or electronic-commerce rights. If a provision is unenforceable, the remaining provisions continue in effect.

16. Contact

For account, privacy, billing, safety, or legal questions, use the support channel provided through your EvoMind account at evomind.ca. Please include enough information to identify the request, but never send a password, private key, access token, or payment password.
